Air ticketing — FRANCE MILES TOURISME (Expatur Travel). Applicable to every quote request and every booking made through us.

01Objet et parties

Les présentes conditions générales de vente (les « CGV ») régissent les prestations de billetterie aérienne fournies par :

  • FRANCE MILES TOURISME, société par actions simplifiée au capital de 100 000 €, exerçant sous le nom commercial EXPATUR TRAVEL (l'« Agence ») ;
  • siège social : Immeuble Les Ibis Rouges, 1 avenue Gustave Charlery, 97300 Cayenne, Guyane française ;
  • SIREN 941 414 112 — SIRET 941 414 112 00016 — RCS Cayenne — code NAF 7911Z ;
  • assurance responsabilité civile professionnelle : HISCOX Europe Underwriting Limited, police n° 6291394 (valable du 01/01/2026 au 31/12/2026) ;
  • contact : administration@expaturtravel.com.

Elles s'appliquent à toute personne (le « Client ») qui sollicite un devis, approuve une proposition ou fait émettre un billet par l'intermédiaire de l'Agence. Toute réservation emporte acceptation pleine et entière des présentes CGV, portées à la connaissance du Client avant la conclusion du contrat.

Les présentes CGV s'appliquent sans préjudice des dispositions impératives du Code de la consommation, du Code du tourisme et du règlement (CE) n° 261/2004 établissant les droits des passagers aériens.

02Définitions

  • Règles tarifaires (fare rules) : conditions fixées par la compagnie aérienne régissant les modifications, remboursements, pénalités, bagages et la validité du billet.
  • PNR : dossier de réservation du passager (Passenger Name Record).
  • Billet électronique : titre de transport émis électroniquement par la compagnie aérienne.
  • Changement d'horaire : modification décidée par la compagnie et portant sur l'heure, la date, l'itinéraire, le transporteur exploitant ou l'appareil.
  • Compagnon de voyage : personne voyageant sur le même itinéraire et aux mêmes dates que le Client, y compris sur un PNR distinct, sous réserve de justificatifs concordants.

03Rôle de l'Agence

L'Agence intervient exclusivement en qualité d'intermédiaire entre le Client et les compagnies aériennes. Elle recherche les tarifs, conseille, réserve, émet les billets, traite les modifications et remboursements dans les limites permises par les règles tarifaires, et assiste le Client sur son itinéraire.

Le transport est exécuté par la compagnie aérienne, seule responsable de son exécution. Les conditions de transport de la compagnie s'appliquent au Client dès l'émission du billet.

04Devis et formation du contrat

La demande de devis effectuée sur le site est gratuite et sans engagement. Aucun paiement n'est demandé à ce stade.

Les tarifs, disponibilités et itinéraires communiqués sont indicatifs et susceptibles d'évoluer jusqu'à l'émission des billets : ils ne constituent pas une offre ferme. Le contrat n'est formé qu'après (a) approbation écrite ou par e-mail de l'itinéraire final par le Client, et (b) encaissement effectif du paiement.

05Réservation et émission des billets

  • Les réservations sont établies sur la base des informations fournies par le Client : noms strictement conformes au passeport, dates de naissance, numéros de fidélité, demandes de services spéciaux.
  • Le Client vérifie l'ensemble des informations (passagers, dates, aéroports, cabines) avant l'émission. Une erreur de nom impose généralement une annulation puis une réémission, aux conditions de la compagnie.
  • L'émission intervient uniquement après approbation de l'itinéraire final et réception effective des fonds.
  • Si le paiement ou l'approbation n'intervient pas avant la date limite d'émission fixée par la compagnie, l'Agence peut annuler la réservation ; les sommes éventuellement versées sont alors intégralement restituées.

Délai de traitement et confirmation. Le traitement de la réservation nécessite généralement un délai de 30 minutes à 1 heure après le paiement. En conséquence, l'e-mail de confirmation peut être adressé jusqu'à 1 heure après le paiement à l'adresse électronique communiquée par le Client.

Dans tous les cas, le moyen de paiement n'est définitivement débité qu'une fois les billets effectivement émis.

06Itinéraire final — règle des 12 heures

Engagement de l'Agence. Après réservation et confirmation du paiement, l'Agence transmet l'itinéraire complet et définitif — incluant le PNR et les numéros de billets électroniques — dans un délai de 12 heures.

À défaut, la réservation est annulée de plein droit et le Client est intégralement remboursé (tarif aérien et frais de service compris, y compris les frais de service de 10 %) sur le moyen de paiement d'origine, sans aucune retenue.

Le Client est informé dans les meilleurs délais en cas de difficulté. Les délais de traitement du remboursement sont ceux prévus à l'article 11. Cette clause ne prive le Client d'aucun autre droit que lui reconnaît la loi.

07Services additionnels — délai d'affichage de 72 heures

Les services accessoires souscrits auprès de l'Agence (bagage supplémentaire, billet bébé, demandes de services spéciaux, sièges payants, etc.) peuvent nécessiter un délai de traitement avant d'apparaître dans la réservation, sur le billet électronique ou dans l'application de la compagnie.

Ce délai peut atteindre 72 heures à compter de la réservation, ou courir jusqu'à 72 heures avant le départ, la date la plus tardive prévalant. Ce délai d'affichage n'affecte ni la validité de l'achat ni celle de l'émission : l'Agence remet au Client un justificatif d'achat pour chaque service additionnel et l'assiste jusqu'à sa prise en compte effective par la compagnie.

Si un service additionnel payé n'est finalement pas fourni, il est remboursé intégralement.

08Prix, frais et paiement

8.1 Prix tout compris

Le montant indiqué sur le devis est un prix total : il inclut le tarif aérien, les taxes et surcharges de la compagnie ainsi que l'ensemble des frais de service de l'Agence. Aucun supplément non annoncé ne peut être ajouté après acceptation du devis.

8.2 Frais de service de 10 %

Tout billet vendu par l'Agence comprend des frais de service de 10 %, déjà inclus dans le prix affiché et identifiés sur le devis et la facture. Ils rémunèrent la recherche tarifaire, le conseil, la réservation, l'émission et l'assistance.

Ces frais ne sont pas remboursables en cas d'annulation à l'initiative du Client, sauf dans les cas suivants, où ils sont intégralement restitués :

  • non-respect par l'Agence du délai de 12 heures (article 6) ;
  • décès du passager, d'un membre de sa famille proche ou d'un compagnon de voyage (article 12) ;
  • annulation du vol par la compagnie ou toute annulation non imputable au Client ;
  • manquement de l'Agence à ses obligations.

8.3 Moyens de paiement

Carte de crédit, carte de débit, virement bancaire, ACH, Revolut Pay. Les paiements par carte sont traités par un prestataire de paiement sécurisé : l'Agence n'a jamais accès aux données bancaires complètes du Client. Les frais bancaires propres au moyen de paiement choisi restent, le cas échéant, à la charge du Client.

8.4 Impayés et contestations de paiement

Le Client reste redevable des sommes correspondant aux prestations effectivement fournies conformément aux présentes. En cas de contestation de paiement (chargeback) portant sur des prestations régulièrement exécutées, l'Agence peut en poursuivre le recouvrement selon les voies de droit commun.

09Droit de rétractation

Absence de droit de rétractation. Conformément à l'article L.221-2, 12° du Code de la consommation, les contrats de transport de passagers ne relèvent pas du régime de la vente à distance ouvrant droit à rétractation. Le Client ne dispose donc pas d'un délai de 14 jours pour se rétracter de l'achat d'un billet d'avion.

Le Client conserve en revanche l'intégralité des droits prévus aux articles 11 (annulation), 12 (décès) et 13 (urgence médicale) des présentes, ainsi que ses droits légaux en cas de retard ou d'annulation du vol.

9.1 Vols au départ des États-Unis — fenêtre d'annulation gratuite de 12 heures

Pour les billets dont le premier vol de l'itinéraire part des États-Unis, et lorsque le billet est émis plus de 7 jours (168 heures) avant le départ prévu, le Client peut annuler et obtenir un remboursement intégral, à condition que la demande soit faite dans un délai de 12 heures à compter de l'émission du billet.

Cette faculté est offerte uniquement pour les itinéraires dont le premier segment part du territoire des États-Unis ; elle ne s'applique pas aux itinéraires débutant hors des États-Unis, ni aux billets émis moins de 7 jours avant le départ. La demande doit être adressée à administration@expaturtravel.com avant l'expiration du délai de 12 heures ; l'horodatage de l'e-mail fait foi.

10Modifications volontaires

10.1 Famille tarifaire retenue

Deux familles tarifaires sont proposées à la réservation. Les conditions du présent article s’appliquent au tarif Economy Standard. Le tarif Economy Saver n’autorise aucune modification, quelle qu’en soit la date : le billet est perdu si le voyage n’est pas effectué.

La famille retenue est celle affichée au moment de la sélection, rappelée sur la page de paiement avant l’acceptation des présentes conditions, et portée sur la facture.

10.2 Frais de modification — tarif Economy Standard

Toute modification demandée par le Client (dates, itinéraire, numéro de vol, informations passagers lorsque les règles tarifaires le permettent) est soumise à la disponibilité au moment de la demande et donne lieu à :

Aucune pénalité d'agence ne s'applique aux modifications volontaires : seuls les frais administratifs ci-dessus et l'éventuelle différence tarifaire sont facturés. L'Agence présente au Client les options disponibles et leur coût ; aucune réémission n'est effectuée sans son accord préalable et exprès.

Toute modification est subordonnée à la disponibilité d'un siège à la nouvelle date demandée, dans la même classe tarifaire que celle initialement réservée. À défaut de siège disponible dans cette classe, la modification ne peut être réalisée ; le Client peut alors retenir une autre date, accepter une classe tarifaire différente lorsqu'elle existe — la différence tarifaire correspondante restant à sa charge —, ou renoncer à la modification. Les frais administratifs ne sont pas dus tant qu'aucune réémission n'a été effectuée.

Un « trajet » s'entend au sens de l'article 11.1 : un déplacement d'un aéroport à un autre à une date donnée, escales comprises.

Certains tarifs sont non modifiables ou soumis à conditions particulières (durée minimale de séjour, achat anticipé). Ces conditions sont communiquées au Client avant l'achat.

11Annulation et remboursement

11.1 Annulation à l'initiative du Client

Le tarif Economy Saver n’est ni remboursable ni modifiable, quelle que soit la compagnie émettrice et quelle que soit la date d’annulation. Le tableau ci-dessous ne concerne que le tarif Economy Standard.

Les conditions d'annulation dépendent de la compagnie sur laquelle le billet est émis :

Un « trajet » désigne un déplacement d'un aéroport à un autre à une date donnée, escales comprises : un aller simple compte un trajet, un aller-retour en compte deux, un multi-destinations autant que de tronçons réservés. Les frais s'entendent dans la devise de facturation, sans conversion.

Aucune pénalité de la compagnie ne s'ajoute à ces frais pour les annulations volontaires relevant de la présente clause. Ces montants sont mis à la disposition du Client avant la conclusion du contrat : ils figurent aux présentes conditions générales, dont l'acceptation expresse est requise pour valider la commande, et sont rappelés sur la page de paiement sous la rubrique « Annulation et modification », que le Client peut consulter d'un simple clic avant de payer. En cochant la case d'acceptation, le Client reconnaît avoir été mis en mesure d'en prendre connaissance. Ils ne peuvent en aucun cas excéder le montant effectivement payé par le Client.

11.2 Modalités

  • Les remboursements sont effectués exclusivement sur le moyen de paiement d'origine.
  • Le traitement par les compagnies peut prendre plusieurs semaines. Une fois les fonds restitués à l'Agence, celle-ci rembourse le Client dans un délai de 30 jours.
  • L'absence de présentation à l'embarquement (no-show) est régie par l'article 11.3.
  • Lorsque l'annulation est imputable à l'Agence ou à la compagnie, le remboursement est intégral, frais de service compris.

11.3 Absence à l'embarquement (« no-show »)

L'absence de présentation à l'embarquement entraîne la perte de la valeur du billet, conformément aux règles tarifaires de la compagnie. Lorsque l'itinéraire comporte plusieurs tronçons, la compagnie annule généralement d'office les tronçons non utilisés, y compris le retour.

Remboursement des taxes. Les taxes et redevances d'aéroport non perçues restent remboursables. Ce remboursement n'est jamais automatique : il doit faire l'objet d'une demande expresse du Client auprès du service client de l'Agence, à administration@expaturtravel.com.

Cette démarche est gratuite. Les frais d'annulation prévus à l'article 11.1 ne s'appliquent pas à une demande de remboursement de taxes. L'Agence en fait la demande auprès de la compagnie et reverse au Client l'intégralité des sommes obtenues, sans retenue de sa part. Seules les retenues éventuellement pratiquées par la compagnie elle-même, en application de ses propres règles tarifaires, peuvent venir en diminution.

Retard aux contrôles de sûreté ou aux frontières. Un retard survenu aux contrôles de sûreté ou d'immigration (TSA, police aux frontières, ou tout autre contrôle) ne constitue pas une cause imputable à l'Agence. Dans cette situation, seule la compagnie aérienne peut, à sa seule discrétion, procéder à un réacheminement sur un vol ultérieur, aux conditions et au tarif qu'elle détermine. L'Agence n'a aucun pouvoir de décision en la matière.

Limite d'intervention de l'Agence. À compter de six heures avant l'heure de départ programmée, le billet passe sous le contrôle exclusif de la compagnie aérienne : l'Agence n'a plus la main sur le dossier et ne peut plus effectuer ni modification, ni annulation, ni réacheminement. Toute demande formulée dans ce délai doit être adressée directement à la compagnie, au comptoir de l'aéroport ou à son service client.

12Politique de remboursement en cas de décès

En cas de décès du passager, d'un membre de sa famille proche ou d'un compagnon de voyage, l'Agence rembourse :

  • 100 % du tarif aérien récupéré auprès de la compagnie ;
  • l'intégralité de ses propres frais de service, y compris les frais de service de 10 %.

Cette politique s'applique quels que soient les tarifs concernés (non remboursables, remboursables avec pénalité, modifiables ou non), sous réserve de l'accord de la compagnie aérienne pour la part du tarif aérien. L'Agence assiste le Client dans ses démarches mais ne peut garantir la décision de la compagnie ; la part relevant de ses propres frais est en revanche remboursée dans tous les cas.

12.1 Famille proche

Sont considérés comme membres de la famille proche : le conjoint ou partenaire (y compris union libre et couples de même sexe) ; les parents, beaux-parents et grands-parents ; les enfants (y compris adoptés et beaux-enfants), gendre et belle-fille, petits-enfants et arrière-petits-enfants ; les frères et sœurs (y compris demi-frères/sœurs et beaux-frères/belles-sœurs) ; le tuteur légal et l'enfant sous tutelle, sur justification.

12.2 Justificatifs

  • acte ou certificat de décès ;
  • certificat médical ou hospitalier, le cas échéant ;
  • preuve du lien de parenté ;
  • décision de tutelle, le cas échéant ;
  • preuve d'un voyage coordonné (itinéraires et dates concordants) si le compagnon voyage sur un PNR distinct.

13Accident ou urgence médicale

Cette politique s'applique lorsque la personne empêchée de voyager est le passager inscrit au PNR, ou un compagnon de voyage voyageant sur un PNR distinct avec preuve d'un voyage coordonné.

Le remboursement du tarif aérien est soumis à l'accord de la compagnie aérienne, qui peut accorder selon les cas un remboursement, une réduction de pénalité, une exonération de frais ou un avoir. Le traitement peut prendre plusieurs semaines.

13.1 Justificatifs

  • certificat médical ou rapport d'hospitalisation attestant l'impossibilité de voyager ;
  • tout justificatif complémentaire (ordre d'hospitalisation, immobilisation…) ;
  • preuve d'un voyage coordonné en cas de PNR distincts ;
  • tout document exigé par la compagnie.

13.2 Procédure

La demande est adressée par e-mail à administration@expaturtravel.com, accompagnée des justificatifs, avant l'heure de départ prévue lorsque cela est matériellement possible. L'horodatage de l'e-mail fait foi.

14Retards, annulations et refus d'embarquement

En cas de changement d'horaire, d'annulation ou de perturbation opérationnelle, l'Agence assiste le Client (réacheminement, demande de remboursement, avoirs) selon les politiques de la compagnie.

Vos droits de passager restent entiers. Pour les vols au départ de l'Union européenne, ainsi que pour les vols à destination de l'UE opérés par un transporteur communautaire, le règlement (CE) n° 261/2004 ouvre, selon les cas, un droit à l'assistance, à la prise en charge (repas, hébergement), au réacheminement, au remboursement, et à une indemnisation forfaitaire de 250 à 600 €. Ces droits s'exercent auprès de la compagnie aérienne, qui en est débitrice. L'Agence accompagne gratuitement le Client dans la constitution de son dossier de réclamation.

Vols au départ de Cayenne (CAY) — contrôles renforcés. Les vols au départ de Cayenne font l'objet de contrôles douaniers et policiers renforcés, pouvant intervenir jusqu'à la porte d'embarquement. En cas de contrôle et d'empêchement d'embarquer, l'Agence n'est pas responsable et aucun remboursement ne peut être obtenu auprès d'elle. La réémission d'un nouveau billet à une date ultérieure n'est possible qu'en agence Air France, aux conditions et au tarif que celle-ci applique.

Le Client informe l'Agence dans les meilleurs délais de toute modification majeure portée à sa connaissance, afin de faciliter son réacheminement.

15Obligations du Client

  • fournir des informations exactes (identités conformes aux passeports, dates de naissance, coordonnées) ;
  • vérifier les confirmations et billets électroniques dès réception et signaler toute anomalie dans les 24 heures ;
  • suivre les communications de la compagnie et de l'aéroport (changements d'horaire, portes, enregistrement) ;
  • se présenter à l'enregistrement et à l'embarquement dans les délais requis ;
  • respecter les règles de bagages (franchises, objets interdits, suppléments éventuels).

16Documents de voyage, immigration et santé

Le Client est seul responsable de la validité de ses documents de voyage : passeport, visas, autorisations électroniques (ESTA, eTA, AVE), visas de transit, billet de retour ou de continuation (« onward ticket »), certificats sanitaires et vaccinations exigées.

L'Agence peut fournir des informations générales à titre indicatif, mais ne garantit ni l'obtention d'un visa, ni l'admission sur le territoire de destination ou de transit. Un refus d'embarquement ou d'entrée fondé sur des documents manquants ou non conformes ne donne lieu à aucun remboursement du prix du billet de la part de l'Agence, sous réserve des taxes visées à l'alinéa suivant.

Effets sur le billet. Un refus d'embarquement fondé sur des documents de voyage produit les mêmes effets qu'une absence à l'embarquement : le billet est perdu et la compagnie annule généralement d'office les tronçons non utilisés, y compris le retour. Les taxes et redevances d'aéroport non perçues restent remboursables sur demande expresse auprès du service client de l'Agence, dans les conditions de l'article 11.3. Un tel refus survenant par nature moins de six heures avant le départ, l'Agence n'a plus accès au dossier : toute demande de réacheminement relève alors de la seule compagnie aérienne, à sa discrétion, comme prévu au même article.

17Responsabilité

L'Agence est responsable, à l'égard du Client, de la bonne exécution de ses propres prestations d'intermédiation : exactitude de la réservation, émission des billets, information et assistance.

N'étant pas le transporteur, elle n'est pas responsable de l'exécution du vol, et notamment : des retards, annulations, changements d'horaire, surréservations, changements d'appareil ou déclassements décidés par la compagnie ; des refus d'embarquement liés à des documents de voyage invalides ou manquants ; des conséquences d'une absence à l'embarquement imputable au Client.

Elle n'est pas davantage tenue des frais consécutifs (hôtels, repas, transports terrestres, vols alternatifs, prestations prépayées perdues) résultant de tels événements : ces prises en charge relèvent de la compagnie aérienne, en application des règles tarifaires, de ses conditions de transport et du règlement (CE) n° 261/2004. L'Agence assiste gratuitement le Client dans la constitution de ses réclamations.

En revanche, l'Agence demeure pleinement responsable de ses propres fautes : erreur de saisie, réservation non effectuée, information erronée ou retard fautif d'émission.

18Force majeure

Aucune des parties ne peut être tenue responsable d'un manquement résultant d'un cas de force majeure au sens de l'article 1218 du Code civil : catastrophes naturelles, guerre, troubles civils, grèves, restrictions gouvernementales, épidémies, pannes majeures des systèmes des compagnies ou des GDS.

19Données personnelles

Les données du Client sont traitées afin d'assurer les prestations, et transmises aux compagnies aériennes, aux GDS et aux prestataires de paiement dans cette seule mesure. La billetterie internationale implique nécessairement des transferts de données hors de l'Union européenne (compagnies, escales, autorités frontalières).

Le détail des traitements, des durées de conservation et des modalités d'exercice de vos droits figure dans notre politique de confidentialité.

20Réclamation et médiation

Toute réclamation est adressée à administration@expaturtravel.com. L'Agence en accuse réception et y répond dans les meilleurs délais.

Conformément aux articles L.611-1 et suivants du Code de la consommation, à défaut de résolution amiable, le Client consommateur peut recourir gratuitement à un médiateur de la consommation :

21Droit applicable et juridiction

21.1 Émission des billets au Brésil

Le Client est informé que l'émission matérielle des billets peut être réalisée par la société mère de l'Agence, EXPATUR AGÊNCIA DE TURISMO LTDA (CNPJ 50.236.211/0001-04, Rua Marília 4200, Tupã — SP, Brésil), société de droit brésilien, via ses accréditations et ses systèmes de distribution (GDS/BSP). Les opérations d'émission, ainsi que les relations entre l'Agence et sa société mère, sont régies par le droit brésilien.

Cette organisation interne au groupe est sans incidence sur les droits du Client vis-à-vis de son vendeur : l'interlocuteur et le cocontractant du Client demeure FRANCE MILES TOURISME.

21.2 Clients professionnels (B2B)

Pour les Clients agissant à des fins professionnelles (agences, entreprises, revendeurs), les présentes CGV sont régies, d'un commun accord, par le droit brésilien, et tout litige relève de la compétence des juridictions brésiliennes du siège de la société mère, sauf stipulation contraire d'un contrat-cadre signé entre les parties.

21.3 Clients consommateurs

Pour les Clients consommateurs, les présentes CGV sont régies par le droit français. Le Client peut saisir, à son choix, la juridiction du lieu de son domicile ou celle du siège de l'Agence.

22Dispositions diverses

22.1 Acceptation et preuve

En approuvant un devis, en cliquant sur le bouton d'acceptation figurant dans l'e-mail de confirmation et en réglant la facture, le Client reconnaît avoir lu, compris et accepté l'intégralité des présentes CGV. L'Agence conserve à titre de preuve la date et l'heure (UTC) de l'acceptation, celles du paiement, ainsi que les références de la facture et de la transaction.

22.2 Version préétablie et version finale

Le devis approuvé constitue une version préétablie du contrat. Après réservation, l'Agence transmet une version finale comportant le PNR et les numéros de billets. Les conditions demeurent identiques entre les deux versions : seules les données d'itinéraire sont complétées.

22.3 Intégralité, divisibilité, renonciation

Les présentes CGV et le devis approuvé constituent l'intégralité de l'accord des parties. Si une clause était déclarée nulle ou réputée non écrite, les autres clauses resteraient applicables. L'absence d'exercice d'un droit ne vaut pas renonciation à celui-ci.

22.4 Signature électronique

Les signatures électroniques et acceptations en ligne ont la même valeur probante qu'une signature manuscrite, conformément aux articles 1366 et 1367 du Code civil.

22.5 Modification des CGV

L'Agence peut modifier les présentes CGV à tout moment. Les conditions applicables à une réservation sont celles en vigueur au jour de son approbation par le Client.

23Vols en correspondance autonome (« self-transfer »)

Lorsqu’un itinéraire proposé par EXPATUR TRAVEL est composé de plusieurs billets distincts, le Client est expressément informé des conditions suivantes :

23.1 Billets séparés

Chaque tronçon fait l’objet d’un contrat de transport indépendant conclu avec une compagnie aérienne distincte. Les compagnies concernées ne sont liées par aucun accord de correspondance entre elles.

23.2 Bagages

À l’escale, le Client doit récupérer ses bagages enregistrés, sortir de la zone de transit et les réenregistrer auprès de la compagnie assurant le vol suivant. Les franchises et frais de bagages s’appliquent séparément à chaque billet.

23.3 Formalités

Le Client doit se soumettre à nouveau aux contrôles de sécurité et, selon l’aéroport d’escale, aux contrôles d’immigration et de douane. Il lui appartient de vérifier qu’il dispose des documents requis, y compris un éventuel visa de transit selon sa nationalité et le pays d’escale.

23.4 Absence de garantie de correspondance

En cas de retard, d’annulation ou de modification du premier vol, la compagnie assurant le vol suivant n’a aucune obligation de réacheminement ni d’indemnisation. Le billet non utilisé est alors perdu, sauf souscription d’une assurance couvrant spécifiquement ce risque. Le temps de correspondance est déterminé par le Client sous sa seule responsabilité.

23.5 Responsabilité

EXPATUR TRAVEL agit en qualité d’intermédiaire et ne saurait être tenue responsable des conséquences d’une correspondance manquée dans les conditions décrites ci-dessus. Le Client reconnaît avoir pris connaissance de ces conditions avant validation de sa réservation.

24Refus d’embarquement ou d’enregistrement imputé au billet

24.1 Situations visées

Le présent article s’applique lorsque le Client se voit refuser l’enregistrement ou l’embarquement et que le personnel de la compagnie ou de l’escale invoque une anomalie du billet : incohérence de réservation, erreur d’identité ou d’orthographe, tronçon non enregistré, billet non émis ou annulé, statut de coupon incorrect, ou toute autre irrégularité rattachée au titre de transport lui-même.

24.2 Document de contingence exigé

Toute demande de remboursement, de réacheminement, d’indemnisation ou de geste commercial fondée sur un tel refus est subordonnée à la remise par le Client d’un document de contingence (« contingency form », « formulário de contingência ») établi au comptoir de la compagnie ou de l’escale, mentionnant :

  • le nom et la fonction de l’agent ayant prononcé le refus ;
  • la date et l’heure du refus, l’aéroport et le numéro de vol concernés ;
  • l’exposé clair et circonstancié du motif invoqué ;
  • la référence de réservation (PNR) et le numéro du billet.

À défaut de formulaire pré-imprimé, une attestation écrite de la compagnie reprenant ces mêmes éléments est admise.

24.3 Moment de la demande

Ce document est demandé au comptoir au moment même du refus, tant que l’agent est identifiable et les faits vérifiables. Le Client est seul en mesure de l’obtenir : l’Agence, qui n’est pas présente à l’aéroport, ne peut ni y suppléer ni le reconstituer après coup. Une déclaration établie ultérieurement, une capture d’écran, un échange verbal ou un témoignage ne peuvent s’y substituer.

24.4 Délai de transmission

Le document est adressé à administration@expaturtravel.com dans les quatorze (14) jours suivant le refus. L’horodatage de l’e-mail fait foi.

24.5 Effet — condition impérative

Aucune demande de remboursement, de quelque nature qu’elle soit, n’est instruite ni traitée en l’absence de ce document lorsqu’elle se fonde sur un refus visé au 24.1 : remboursement total ou partiel, avoir, bon de voyage, indemnisation, prise en charge de frais, exonération de pénalité ou geste commercial. Cette exigence est une condition de recevabilité : elle ne peut être suppléée par aucun autre élément, ni régularisée après l’expiration du délai prévu au 24.4.

Sa production ne préjuge pas du bien-fondé de la demande : elle en conditionne l’examen, non l’issue. Lorsque l’anomalie est établie et imputable à l’Agence, celle-ci prend en charge la régularisation et le remboursement dans les conditions des articles 11 et 17. Lorsqu’elle est imputable à la compagnie, l’Agence assiste le Client dans son dossier de réclamation, sans se substituer au transporteur.

24.6 Réserve

Le présent article ne s’applique pas aux refus fondés sur les documents de voyage (article 16), ni aux refus d’embarquement pour surréservation ou motif opérationnel relevant de la réglementation applicable (article 14), pour lesquels la compagnie délivre ses propres notifications. Il ne fait échec à aucun droit que le Client tient de la loi.

01Purpose and parties

These general terms and conditions of sale (the « T&Cs ») govern the air-ticketing services provided by:

  • FRANCE MILES TOURISME, a simplified joint-stock company with capital of €100,000, trading under the commercial name EXPATUR TRAVEL (the « Agency »);
  • registered office: Immeuble Les Ibis Rouges, 1 avenue Gustave Charlery, 97300 Cayenne, French Guiana;
  • SIREN 941 414 112 — SIRET 941 414 112 00016 — RCS Cayenne — NAF code 7911Z;
  • professional liability insurance: HISCOX Europe Underwriting Limited, policy No. 6291394 (valid from 01/01/2026 to 31/12/2026);
  • contact: administration@expaturtravel.com.

They apply to any person (the « Client ») who requests a quote, approves a proposal or has a ticket issued through the Agency. Any booking entails full and complete acceptance of these T&Cs, brought to the Client's attention before the conclusion of the contract.

These T&Cs apply without prejudice to the mandatory provisions of the French Consumer Code, the French Tourism Code and Regulation (EC) No. 261/2004 establishing air passengers' rights.

02Definitions

  • Fare rules: conditions set by the airline governing changes, refunds, penalties, baggage and the ticket's validity.
  • PNR: the passenger's booking file (Passenger Name Record).
  • E-ticket: transport document issued electronically by the airline.
  • Schedule change: a change decided by the airline affecting the time, date, itinerary, operating carrier or aircraft.
  • Travel companion: a person travelling on the same itinerary and dates as the Client, including on a separate PNR, subject to matching supporting documents.

03Role of the Agency

The Agency acts exclusively as an intermediary between the Client and the airlines. It searches for fares, advises, books, issues tickets, handles changes and refunds within the limits allowed by the fare rules, and assists the Client with their itinerary.

The transport is performed by the airline, which is solely responsible for its performance. The airline's conditions of carriage apply to the Client as soon as the ticket is issued.

04Quote and formation of the contract

The quote request made on the site is free and without obligation. No payment is requested at this stage.

The fares, availability and itineraries provided are indicative and may change until the tickets are issued: they do not constitute a firm offer. The contract is formed only after (a) written or e-mail approval of the final itinerary by the Client, and (b) actual receipt of payment.

05Booking and ticket issuance

  • Bookings are made on the basis of the information provided by the Client: names strictly matching the passport, dates of birth, loyalty numbers, special-service requests.
  • The Client checks all the information (passengers, dates, airports, cabins) before issuance. A name error generally requires cancellation and then re-issuance, subject to the airline's conditions.
  • Issuance takes place only after approval of the final itinerary and actual receipt of the funds.
  • If payment or approval does not occur before the issuance deadline set by the airline, the Agency may cancel the booking; any sums paid are then refunded in full.

Processing time and confirmation. Processing a booking usually takes 30 minutes to 1 hour after payment. As a result, the confirmation email may be sent up to 1 hour after payment to the email address provided by the Client.

In all cases, the payment method is only definitively charged once the tickets have actually been issued.

06Final itinerary — the 12-hour rule

Agency commitment. After booking and payment confirmation, the Agency sends the complete and final itinerary — including the PNR and e-ticket numbers — within 12 hours.

Failing this, the booking is cancelled by operation of law and the Client is refunded in full (air fare and service fees included, including the 10% service fee) to the original means of payment, with no deduction.

The Client is informed as soon as possible in the event of difficulty. The refund processing times are those set out in Article 11. This clause does not deprive the Client of any other right granted to them by law.

07Additional services — 72-hour display time

Ancillary services purchased from the Agency (extra baggage, infant ticket, special-service requests, paid seats, etc.) may require processing time before appearing in the booking, on the e-ticket or in the airline's app.

This time may reach 72 hours from the booking, or run until 72 hours before departure, whichever is later. This display time affects neither the validity of the purchase nor that of the issuance: the Agency provides the Client with proof of purchase for each additional service and assists them until it is effectively taken into account by the airline.

If a paid additional service is ultimately not provided, it is refunded in full.

08Price, fees and payment

8.1 All-inclusive price

The amount shown on the quote is a total price: it includes the air fare, the airline's taxes and surcharges as well as all of the Agency's service fees. No undisclosed supplement may be added after acceptance of the quote.

8.2 10% service fee

Every ticket sold by the Agency includes a 10% service fee, already included in the displayed price and identified on the quote and invoice. It remunerates fare research, advice, booking, issuance and assistance.

These fees are non-refundable in the event of cancellation by the Client, except in the following cases, where they are refunded in full:

  • failure by the Agency to meet the 12-hour deadline (Article 6);
  • death of the passenger, of a member of their close family or of a travel companion (Article 12);
  • cancellation of the flight by the airline or any cancellation not attributable to the Client;
  • failure by the Agency to meet its obligations.

8.3 Means of payment

Credit card, debit card, bank transfer, ACH, Revolut Pay. Card payments are processed by a secure payment provider: the Agency never has access to the Client's full banking data. Bank charges specific to the chosen means of payment remain, where applicable, the Client's responsibility.

8.4 Unpaid amounts and payment disputes

The Client remains liable for the sums corresponding to the services actually provided in accordance herewith. In the event of a payment dispute (chargeback) concerning services duly performed, the Agency may pursue recovery through the ordinary channels of law.

09Right of withdrawal

No right of withdrawal. In accordance with Article L.221-2, 12° of the French Consumer Code, passenger transport contracts do not fall within the distance-selling regime that grants a right of withdrawal. The Client therefore does not have a 14-day period to withdraw from the purchase of a plane ticket.

The Client nonetheless retains all the rights provided for in Articles 11 (cancellation), 12 (death) and 13 (medical emergency) hereof, as well as their statutory rights in the event of flight delay or cancellation.

9.1 Flights departing the United States — 12-hour free cancellation window

For tickets whose first flight in the itinerary departs from the United States, and where the ticket is issued more than 7 days (168 hours) before the scheduled departure, the Client may cancel and obtain a full refund, provided the request is made within 12 hours of the ticket being issued.

This option is offered only for itineraries whose first segment departs from U.S. territory; it does not apply to itineraries beginning outside the United States, nor to tickets issued less than 7 days before departure. The request must be sent to administration@expaturtravel.com before the 12-hour window expires; the timestamp of the e-mail is authoritative.

10Voluntary changes

10.1 Fare family selected

Two fare families are offered at booking. The terms of this article apply to the Economy Standard fare. The Economy Saver fare allows no change, whatever the date: the ticket is lost if the journey is not taken.

The family selected is the one displayed at the time of selection, restated on the payment page before these terms are accepted, and shown on the invoice.

10.2 Change fees — Economy Standard fare

Any change requested by the Client (dates, itinerary, flight number, passenger information where the fare rules allow) is subject to availability at the time of the request and gives rise to:

No agency penalty applies to voluntary changes: only the administrative fees above and any fare difference are charged. The Agency presents the Client with the available options and their cost; no re-issuance is carried out without their prior and express agreement.

Any change is subject to a seat being available on the newly requested date, in the same fare class as originally booked. If no seat is available in that class, the change cannot be made; the Client may then choose another date, accept a different fare class where one exists — the corresponding fare difference remaining payable by them — or forgo the change. Administrative fees are not due as long as no re-issuance has been carried out.

A « journey » has the meaning given in article 11.1: travel from one airport to another on a given date, connections included.

Some fares are non-changeable or subject to special conditions (minimum length of stay, advance purchase). These conditions are communicated to the Client before purchase.

11Cancellation and refund

11.1 Cancellation by the Client

The Economy Saver fare is neither refundable nor changeable, whatever the issuing airline and whatever the cancellation date. The table below applies to the Economy Standard fare only.

A « journey » means travel from one airport to another on a given date, connections included: a one way counts as one journey, a round trip as two, a multi-city itinerary as many as the segments booked. Fees are expressed in the billing currency, without conversion.

No airline penalty is added to these fees for voluntary cancellations under this clause. These amounts are made available to the Client before the conclusion of the contract: they appear in these terms and conditions, whose express acceptance is required to place the order, and are restated on the payment page under « Cancellation and changes », which the Client may open with a single click before paying. By ticking the acceptance box, the Client acknowledges having been given the opportunity to read them. They may in no case exceed the amount actually paid by the Client.

11.2 Terms

  • Refunds are made exclusively to the original means of payment.
  • Processing by the airlines may take several weeks. Once the funds are returned to the Agency, the latter refunds the Client within 30 days.
  • Failure to show up for boarding (no-show) is governed by article 11.3.
  • Where the cancellation is attributable to the Agency or the airline, the refund is full, service fees included.

11.3 Failure to board (« no-show »)

Failure to present for boarding results in the loss of the ticket's value, in accordance with the airline's fare rules. Where the itinerary comprises several segments, the airline will generally cancel all unused segments automatically, including the return.

Refund of taxes. Airport taxes and charges not levied remain refundable. This refund is never automatic: it requires an express request from the Client to the Agency's customer service at administration@expaturtravel.com.

This request is free of charge. The cancellation fees set out in article 11.1 do not apply to a request for a refund of taxes. The Agency files the claim with the airline and passes on to the Client the full amount recovered, with no deduction of its own. Only deductions applied by the airline itself, under its own fare rules, may reduce that amount.

Delays at security or border control. A delay at security or immigration control (TSA, border police, or any other checkpoint) is not attributable to the Agency. In such cases, only the airline may, at its sole discretion, rebook the passenger on a later flight, on the terms and at the fare it determines. The Agency has no decision-making power in this matter.

Limit of the Agency's involvement. From six hours before the scheduled departure time, the ticket falls under the airline's exclusive control: the Agency no longer has access to the booking and can no longer make any change, cancellation or rebooking. Any request made within that window must be addressed directly to the airline, at the airport counter or through its customer service.

12Refund policy in the event of death

In the event of the death of the passenger, of a member of their close family or of a travel companion, the Agency refunds:

  • 100% of the air fare recovered from the airline;
  • the entirety of its own service fees, including the 10% service fee.

This policy applies whatever the fares concerned (non-refundable, refundable with penalty, changeable or not), subject to the airline's agreement for the air-fare portion. The Agency assists the Client in their procedures but cannot guarantee the airline's decision; the portion relating to its own fees is, on the other hand, refunded in all cases.

12.1 Close family

The following are considered members of the close family: the spouse or partner (including common-law and same-sex couples); parents, parents-in-law and grandparents; children (including adopted children and stepchildren), son-in-law and daughter-in-law, grandchildren and great-grandchildren; siblings (including half-siblings and siblings-in-law); the legal guardian and the child under guardianship, on proof.

12.2 Supporting documents

  • death record or certificate;
  • medical or hospital certificate, where applicable;
  • proof of the family relationship;
  • guardianship decision, where applicable;
  • proof of a coordinated trip (matching itineraries and dates) if the companion travels on a separate PNR.

13Accident or medical emergency

This policy applies where the person prevented from travelling is the passenger listed on the PNR, or a travel companion travelling on a separate PNR with proof of a coordinated trip.

The refund of the air fare is subject to the airline's agreement, which may grant, depending on the case, a refund, a reduction of the penalty, a waiver of fees or a credit. Processing may take several weeks.

13.1 Supporting documents

  • medical certificate or hospitalisation report attesting to the impossibility of travelling;
  • any additional supporting document (hospitalisation order, immobilisation, etc.);
  • proof of a coordinated trip in the case of separate PNRs;
  • any document required by the airline.

13.2 Procedure

The request is sent by e-mail to administration@expaturtravel.com, together with the supporting documents, before the scheduled departure time where materially possible. The timestamp of the e-mail is authoritative.

14Delays, cancellations and denied boarding

In the event of a schedule change, cancellation or operational disruption, the Agency assists the Client (re-routing, refund request, credits) according to the airline's policies.

Your passenger rights remain intact. For flights departing the European Union, as well as for flights to the EU operated by a Community carrier, Regulation (EC) No. 261/2004 grants, depending on the case, a right to assistance, to care (meals, accommodation), to re-routing, to a refund, and to standard compensation of €250 to €600. These rights are exercised against the airline, which is the debtor of them. The Agency assists the Client free of charge in putting together their claim file.

Flights departing Cayenne (CAY) — enhanced controls. Flights departing Cayenne are subject to enhanced customs and police controls, which may take place up to the boarding gate. Should such a control prevent boarding, the Agency is not liable and no refund may be obtained from it. Re-issuing a new ticket for a later date is only possible at an Air France agency, on the terms and at the fare it applies.

The Client informs the Agency as soon as possible of any major change brought to their attention, in order to facilitate their re-routing.

15Client obligations

  • provide accurate information (identities matching the passports, dates of birth, contact details);
  • check the confirmations and e-tickets on receipt and report any discrepancy within 24 hours;
  • follow the airline's and airport's communications (schedule changes, gates, check-in);
  • turn up for check-in and boarding within the required times;
  • comply with the baggage rules (allowances, prohibited items, any surcharges).

16Travel documents, immigration and health

The Client is solely responsible for the validity of their travel documents: passport, visas, electronic authorisations (ESTA, eTA, AVE), transit visas, return or onward ticket, health certificates and required vaccinations.

The Agency may provide general information for guidance, but guarantees neither the obtaining of a visa, nor admission to the territory of destination or transit. Denied boarding or entry based on missing or non-compliant documents does not give rise to any refund of the ticket price from the Agency, subject to the taxes referred to in the following paragraph.

Effect on the ticket. A denial of boarding based on travel documents has the same consequences as a failure to board: the ticket is lost and the airline will generally cancel all unused segments automatically, including the return. Airport taxes and charges not levied remain refundable upon express request to the Agency's customer service, under the conditions of article 11.3. As such a denial necessarily occurs less than six hours before departure, the Agency no longer has access to the booking: any rebooking request is then a matter for the airline alone, at its sole discretion, as set out in that same article.

17Liability

The Agency is liable, towards the Client, for the proper performance of its own intermediation services: accuracy of the booking, issuance of the tickets, information and assistance.

Not being the carrier, it is not liable for the performance of the flight, and in particular: delays, cancellations, schedule changes, overbooking, aircraft changes or downgrades decided by the airline; denied boarding linked to invalid or missing travel documents; the consequences of a failure to board attributable to the Client.

Nor is it liable for consequential costs (hotels, meals, ground transport, alternative flights, lost prepaid services) resulting from such events: this care is the responsibility of the airline, pursuant to the fare rules, its conditions of carriage and Regulation (EC) No. 261/2004. The Agency assists the Client free of charge in putting together their claims.

On the other hand, the Agency remains fully liable for its own faults: input error, booking not made, incorrect information or wrongful delay in issuance.

18Force majeure

Neither party may be held liable for a breach resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code: natural disasters, war, civil unrest, strikes, government restrictions, epidemics, major failures of the airlines' or the GDS systems.

19Personal data

The Client's data is processed in order to provide the services, and passed to the airlines, the GDSs and the payment providers to that extent only. International ticketing necessarily involves transfers of data outside the European Union (airlines, stopovers, border authorities).

20Complaints and mediation

Any complaint is sent to administration@expaturtravel.com. The Agency acknowledges receipt and responds as soon as possible.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, failing an amicable resolution, the consumer Client may have free recourse to a consumer mediator:

21Governing law and jurisdiction

21.1 Ticket issuance in Brazil

The Client is informed that the physical issuance of the tickets may be carried out by the Agency's parent company, EXPATUR AGÊNCIA DE TURISMO LTDA (CNPJ 50.236.211/0001-04, Rua Marília 4200, Tupã — SP, Brazil), a company incorporated under Brazilian law, via its accreditations and distribution systems (GDS/BSP). The issuance operations, as well as the relations between the Agency and its parent company, are governed by Brazilian law.

This intra-group internal organisation has no bearing on the Client's rights vis-à-vis their seller: the Client's contact and counterparty remains FRANCE MILES TOURISME.

21.2 Business clients (B2B)

For Clients acting for professional purposes (agencies, companies, resellers), these T&Cs are governed, by mutual agreement, by Brazilian law, and any dispute falls within the jurisdiction of the Brazilian courts of the parent company's registered office, unless otherwise stipulated in a framework agreement signed between the parties.

21.3 Consumer clients

For consumer Clients, these T&Cs are governed by French law. The Client may bring the matter, at their choice, before the court of the place of their domicile or that of the Agency's registered office.

22Miscellaneous

22.1 Acceptance and proof

By approving a quote, clicking the acceptance button in the confirmation e-mail and paying the invoice, the Client acknowledges having read, understood and accepted all of these T&Cs. The Agency retains, as proof, the date and time (UTC) of acceptance, those of payment, as well as the invoice and transaction references.

22.2 Preliminary version and final version

The approved quote constitutes a preliminary version of the contract. After booking, the Agency sends a final version including the PNR and ticket numbers. The conditions remain identical between the two versions: only the itinerary data is completed.

22.3 Entirety, severability, waiver

These T&Cs and the approved quote constitute the entire agreement between the parties. If a clause were declared void or deemed unwritten, the other clauses would remain applicable. The failure to exercise a right does not constitute a waiver of it.

22.4 Electronic signature

Electronic signatures and online acceptances have the same evidential value as a handwritten signature, in accordance with Articles 1366 and 1367 of the French Civil Code.

22.5 Amendment of the T&Cs

The Agency may amend these T&Cs at any time. The conditions applicable to a booking are those in force on the day of its approval by the Client.

23Self-transfer connecting flights

Where an itinerary offered by EXPATUR TRAVEL is made up of several separate tickets, the Client is expressly informed of the following conditions:

23.1 Separate tickets

Each leg is the subject of an independent contract of carriage entered into with a different airline. The airlines concerned are not bound by any connection agreement between them.

23.2 Baggage

At the stopover, the Client must collect their checked baggage, leave the transit area and check it in again with the airline operating the following flight. Baggage allowances and fees apply separately to each ticket.

23.3 Formalities

The Client must go through security checks again and, depending on the stopover airport, through immigration and customs. It is the Client’s responsibility to ensure they hold the required documents, including any transit visa depending on their nationality and the country of the stopover.

23.4 No connection guarantee

In the event of delay, cancellation or change to the first flight, the airline operating the following flight has no obligation to re-route or compensate. The unused ticket is then lost, unless insurance specifically covering this risk has been taken out. The connection time is determined by the Client under their sole responsibility.

23.5 Liability

EXPATUR TRAVEL acts as an intermediary and cannot be held liable for the consequences of a missed connection under the conditions described above. The Client acknowledges having read these conditions before confirming their booking.

24Denied boarding or check-in attributed to the ticket

24.1 Scope

This article applies where the Client is refused check-in or boarding and the airline or ground-handling staff invokes a ticket irregularity: booking inconsistency, name or spelling error, unregistered segment, ticket not issued or cancelled, incorrect coupon status, or any other irregularity attaching to the travel document itself.

24.2 Contingency form required

Any request for a refund, re-routing, compensation or goodwill gesture based on such a refusal is conditional upon the Client producing a contingency form issued at the airline or handling agent’s desk, stating:

  • the name and role of the agent who issued the refusal;
  • the date and time of the refusal, the airport and the flight number concerned;
  • a clear and detailed statement of the reason given;
  • the booking reference (PNR) and the ticket number.

Where no pre-printed form exists, a written statement from the airline containing the same particulars is accepted.

24.3 When it must be obtained

This document must be requested at the desk at the moment of the refusal, while the agent is identifiable and the facts verifiable. Only the Client can obtain it: the Agency is not present at the airport and can neither substitute for it nor reconstruct it afterwards. A statement drawn up later, a screenshot, a verbal exchange or a witness account cannot take its place.

24.4 Time limit

The document must be sent to administration@expaturtravel.com within fourteen (14) days of the refusal. The email timestamp is authoritative.

24.5 Effect — mandatory condition

No refund request of any nature whatsoever will be examined or processed without this document where it is based on a refusal falling under 24.1: full or partial refund, credit, travel voucher, compensation, reimbursement of costs, waiver of a penalty or goodwill gesture. This requirement is a condition of admissibility: nothing else can stand in its place, and it cannot be cured after the time limit set out in 24.4 has expired.

Producing it does not prejudge the merits of the request: it conditions the examination, not the outcome. Where the irregularity is established and attributable to the Agency, the Agency bears the correction and the refund under articles 11 and 17. Where it is attributable to the airline, the Agency assists the Client with the claim without standing in for the carrier.

24.6 Reservation

This article does not apply to refusals based on travel documents (article 16), nor to denied boarding for overbooking or operational reasons governed by applicable regulation (article 14), for which the airline issues its own notices. It does not defeat any right the Client holds under the law.
